The Supreme Court has declared Khushhal Khan Kakak the successful candidate from NA-251 and directed the Election Commission to issue his victory notification.
The case was heard by a three-member bench headed by Justice Shahid Waheed. The petitioner’s lawyer, Salman Akram Raja, argued that the dispute revolved around Form 45. He said that in ten polling stations, there were discrepancies between Forms 45 and 47, which resulted in 100 votes being deducted from his client while the rival candidate Syed Samiullah received an inflated count.
Justice Naeem Akhtar Afghan remarked that the formula used to calculate the votes seemed to account for exactly 100 votes. The hearing also included discussion on the legal provisions for action against returning officers, with the Election Commission’s lawyer stating that the law contains a comprehensive section on this matter.
